AWR - What's it all about?

The new Agency Worker Regulations (AWR) and what they mean for Employers

What are they?

The new Agency Worker Regulations (AWR) came into force on the 1st of October 2011. They are designed to get temporary workers the same rights as permanent ones and the actual repercussions of this are in essence that a temporary worker has to get a comparative level of pay as a permanent employee performing a comparative role and duties.

How do I comply?

To ensure compliance you need to confirm that any temporary worker employed is on a comparative pay structure to any permanent employee you have in the same or similar level of position.
Where an identical role is not in existence presently in your company you just need to make an informed estimate as to what the permanent equivalent salary would be given your current staffing structure.

How does this change the way I work?

It doesn’t!

The new AWR doesn’t involve many other changes at all to the way we work with you to recruit for temporary vacancies. We and most of our clients are already AWR compliant due to the numerous changes that have been made in previous years regarding minimum wage, equal opportunities and the working time directive etc.
Reputable organisations, big and small already implement ‘best practice’ when it comes to treating the recruitment and employment of staff. It’s all about equal and fair rights and opportunities, so despite the scare-mongering, Tribunals will rarely come down hard on any employer who can prove that they conduct themselves professionally, morally and ethically when it comes to employing anyone to do a job for them: be that a contract-worker, consultancy or bureau or a temporary or permanent employee. The ‘spirit’ of the law still prevails and our justice system here in the UK (despite this being a European initiative) generally bears this out.

Henceforth, each time we place a temp with you we will simply conduct one additional check to ensure that the pay rate of the temp is an equal and fair rate given your current pay structure. Job done!

If you have any questions, queries or worries please call us to discuss and we will be more than happy to lay your fears to rest.
